Aren't Defamation laws unconstitutional?

..the Court has a long-standing precedent that the "right" of speech and any damages caused by that speech are two seperate things. We have the Consitutional right to own a gun, but there are still established laws in place that dictate HOW that gun may or may not be used within the realm of "law."
